Terms of Service

1. Agreement to Terms

By accessing or using the SymplTorque Workshop Management System (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

These Terms form a legally binding agreement between you (“the Customer”) and SymplTorque (Pty) Ltd (“SymplTorque”, “we”, “us”).

2. Description of Service

SymplTorque WMS is a cloud-based workshop management system that provides digital jobcard management, SARS-compliant invoicing, parts and inventory tracking, customer relationship management, and related services for South African automotive workshops.

3. Account Responsibilities

  • You are responsible for maintaining the confidentiality of your account credentials
  • You must provide accurate and complete information when registering
  • You are responsible for all activity that occurs under your account
  • You must notify us immediately of any unauthorized use of your account
  • Multi-factor authentication is required for administrator and owner accounts

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service or any other user's data
  • Interfere with or disrupt the integrity or performance of the Service
  • Share access credentials with unauthorized persons outside your organization
  • Use the Service to process personal information beyond the stated purposes

5. Data and Privacy

You acknowledge that the customer data you enter into the Service is subject to POPIA. As the workshop operator, you are the responsible party for your customers' personal information. SymplTorque acts as an operator processing data on your behalf.

You must obtain all necessary consents from your customers before sending WhatsApp, SMS, or email communications through the Service.

Our collection and use of your personal information is governed by our Privacy Policy.

6. Subscription and Payment

  • Subscriptions are billed monthly or annually in South African Rand (ZAR), inclusive of 15% VAT
  • Payments are processed by Paystack and are subject to Paystack's terms
  • Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date
  • Refunds are not provided for partial months except as required by South African consumer protection law

7. Service Availability

We aim for 99.5% monthly uptime excluding scheduled maintenance. We will provide at least 24 hours' notice for planned downtime. We are not liable for outages caused by third-party services, internet failures, or force majeure events.

8. Intellectual Property

The Service, including all software, design, and content, is owned by SymplTorque (Pty) Ltd. Your subscription grants you a non-exclusive, non-transferable right to use the Service for your internal business purposes.

You retain ownership of all data you upload or create through the Service.

9. Limitation of Liability

To the maximum extent permitted by South African law, SymplTorque's total liability is limited to the fees paid by you in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

10. Termination

Either party may terminate the subscription with 30 days' written notice. We may suspend or terminate your account immediately for material breach of these Terms, including non-payment or illegal use. Upon termination, your data is retained for the legally required period and then securely deleted.

11. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes will be subject to the jurisdiction of the South African courts.
